On Monday the San Jose Police Department says it won鈥檛 release the police report or the 911 tape from the McDonald arrest. The information is public record (The Chronicle has filed a public information request). It appears that McDonald is getting every benefit of the doubt as well. Most of the witnesses were his teammates. The whisper campaign is underway. Maybe there won鈥檛 ever be any charges filed. We may never know what happened that night. But the legal and judicial systems have failed plenty of victims before.
